SPONSOR
The Destination Markham 2026 Markham Fair Family Pass Giveaway (the “Contest”) is sponsored and administered by Destination Markham Corporation (“Destination Markham” or the “Sponsor”).
The Markham and East York Agricultural Society, operating as Markham Fair (“Markham Fair”), is providing the Prizes and arranging electronic Prize fulfilment but is not responsible for the administration of the Contest or selection of winners.
ELIGIBILITY
The Contest is open to all legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry.
The Contest is not open to elected officials, officers, directors, employees, representatives or agents of Destination Markham Corporation, the City of Markham, Markham Fair, or any of their respective affiliates, advertising or promotional agencies, contractors, prize suppliers or promotional partners, nor to members of their immediate families or households.
For the purposes of these Contest Rules, “immediate family” includes a spouse, parent, child or sibling, whether or not they reside in the same household.
Destination Markham Corporation reserves the right, at any time and in its sole discretion, to verify the eligibility of any entrant or selected potential winner.
CONTEST PERIOD
The Contest begins on Thursday, September 24, 2026 at 10:00 a.m. Eastern Time (“ET”) and ends on Sunday, September 27, 2026 at 11:59 p.m. ET (the “Contest Period”).
Entries received before or after the Contest Period will not be eligible.
ENTRY
No purchase is necessary to enter or win the Contest.
To receive one (1) entry during the Contest Period, an eligible individual must complete all of the following requirements using a valid Instagram account:
1. Like the designated Contest post published by @visitmarkham;
2. Follow @visitmarkham on Instagram;
3. Follow @markhamfair on Instagram; and
4. Comment on the designated Contest post and tag at least one (1) friend.
Unlimited entries are permitted during the Contest Period. Each separate eligible comment tagging at least one (1) valid Instagram account belonging to another person will count as one (1) entry.
Duplicate comments, automated entries, bot-generated entries, mechanically reproduced entries, entries submitted through scripts or other automated means, or entries otherwise submitted in a manner intended to interfere with the proper administration of the Contest will not be eligible.
The person tagged in an entry is not required to enter the Contest.
The entrant must continue to follow both @visitmarkham and @markhamfair and must not delete their eligible comment before the random draw and winner-verification process have been completed.
The entrant must use an Instagram account that the entrant is authorized to use. Destination Markham Corporation reserves the right to disqualify entries submitted through fraudulent accounts, automated systems or other methods intended to circumvent these Contest Rules.
BONUS ENTRY: NEWSLETTER SIGN-UP
During the Contest Period, an eligible entrant may receive one (1) additional entry by voluntarily providing express consent to receive Destination Markham Corporation’s electronic newsletter and other commercial electronic messages through the newsletter registration form available through the link in the @visitmarkham Instagram biography.
Limit of one (1) bonus newsletter entry per eligible person.
To receive the bonus entry, the entrant must provide the information requested through the newsletter registration process, including their Instagram username where requested, so that Destination Markham Corporation can reasonably verify and associate the bonus entry with the entrant.
Providing consent to receive Destination Markham Corporation’s electronic newsletter or other commercial electronic messages is not required to enter the Contest or to be eligible to win through the regular Instagram entry method.
Newsletter consent must be provided through an affirmative opt-in mechanism. Entrants may withdraw their consent to receive commercial electronic messages at any time by using the unsubscribe mechanism included in such messages. Withdrawing marketing consent after an eligible bonus entry has been submitted will not invalidate that entry.
ENTRY CONDITIONS
Entries must comply with these Contest Rules and with Instagram’s applicable terms, policies and community standards.
Destination Markham Corporation reserves the right, in its sole discretion, to disqualify any entry that contains inappropriate, offensive, threatening, discriminatory, defamatory, unlawful or otherwise objectionable content.
Destination Markham Corporation is not responsible for entries that are lost, late, incomplete, deleted, hidden, filtered, misdirected, inaccessible or otherwise not received or capable of being verified.
All Contest entry records become the property of Destination Markham Corporation and will not be returned.
By entering the Contest, entrants authorize Destination Markham Corporation to use information submitted in connection with the entry for the purposes of administering the Contest, confirming eligibility, contacting selected entrants and awarding the Prizes.
PRIZES
There are three (3) prizes available to be won (each, a “Prize”), with three (3) separate winners.
Each Prize consists of one (1) Special Family Pass to the 2026 Markham Fair, providing admission for two (2) adults and up to three (3) children, with an approximate retail value of sixty dollars ($60 CAD).
The total approximate retail value of all three (3) Prizes is one hundred and eighty dollars ($180 CAD).
The 2026 Markham Fair is scheduled to take place from Thursday, October 1 through Sunday, October 4, 2026 at the Markham Fairgrounds in Markham, Ontario.
Each winner may receive only one (1) Prize.
Each Prize provides admission only in accordance with the terms, conditions and access rights associated with the Family Pass.
Each Prize must be accepted as awarded and is not transferable, assignable or redeemable for cash, in whole or in part.
The Prize may not be sold, resold, auctioned or used for any commercial, advertising or promotional purpose.
No substitutions will be made except at the sole discretion of Destination Markham Corporation. Destination Markham Corporation reserves the right to substitute a Prize or any component thereof with a prize of equal or greater value if the advertised Prize becomes unavailable for any reason.
ELECTRONIC PRIZE DELIVERY
The Prizes will be delivered electronically through Markham Fair’s ticketing provider.
Each confirmed winner will be required to provide a valid email address for the purpose of arranging electronic delivery of the Prize.
Destination Markham Corporation may provide a confirmed winner’s name and email address to Markham Fair and/or its ticketing provider solely for the purpose of fulfilling and delivering the Prize.
Each winner is responsible for providing accurate information, monitoring their email including junk or spam folders, and completing any steps reasonably required to receive or access the electronic Family Pass.
The winner and their guests must comply with all ticket conditions, venue policies, security requirements and instructions imposed by Markham Fair, the ticket issuer and the venue.
PRIZE EXCLUSIONS
The Prize does not include transportation to or from the Markham Fairgrounds, accommodation, midway rides or games, food or beverages, merchandise, insurance, gratuities, personal expenses or any other costs, taxes or fees not expressly identified as part of the Prize.
All such expenses are the sole responsibility of the winner and their guests.
EVENT CHANGES OR CANCELLATION
Fair dates, hours, attractions, entertainment, programming and activities are subject to change without notice.
If the Markham Fair, or any portion of it, is postponed, rescheduled, interrupted or cancelled for any reason outside the reasonable control of Destination Markham Corporation, Destination Markham Corporation will not be responsible for providing compensation or replacing the Prize, except at its sole discretion.
If a Prize remains valid for a rescheduled date, the winner will be responsible for attending on the rescheduled date and for any resulting expenses.
ODDS OF WINNING
The odds of winning depend on the total number of eligible Instagram entries and bonus newsletter entries received during the Contest Period.
DRAW
Three (3) potential winners will be selected by random draw from among all eligible entries received during the Contest Period.
The draw will take place on Monday, September 28, 2026 in Markham, Ontario.
Each selected entrant is eligible to win one (1) Prize only.
Each selected entrant will be considered a potential winner until all eligibility, skill-testing, documentation and Prize-claim requirements contained in these Contest Rules have been satisfied.
WINNER NOTIFICATION
The three (3) selected potential winners will be contacted through a direct message sent only from the official @visitmarkham Instagram account on Monday, September 28, 2026, with initial winner notifications to be sent by approximately 10:00 a.m. ET.
Destination Markham Corporation will not request payment, banking information, credit card information, gift cards or any fee from a selected entrant in order to claim a Prize.
Each selected entrant must respond to the initial notification within twenty-four (24) hours after the direct message is sent.
Selected entrants should monitor their Instagram direct messages, including message-request and filtered-message folders, following the close of the Contest.
Destination Markham Corporation may request a selected entrant’s full name, email address, telephone number, city and province or territory of residence, Instagram username and reasonable evidence necessary to verify age, identity or residency.
If a selected entrant does not respond within twenty-four (24) hours after the initial notification is sent, cannot be contacted, fails to provide requested information within the time specified, is determined to be ineligible, fails to correctly answer the mathematical skill-testing question, fails to complete and return the required Prize Claim Form, declines the Prize or otherwise fails to comply with these Contest Rules, the selected entrant will be disqualified and the Prize will be forfeited.
Destination Markham Corporation may then select another potential winner by random draw from among the remaining eligible entries.
An alternate selected entrant will be required to respond within the period specified in their notification. Due to the date-specific nature of the Prize, that response period may be shorter than twenty-four (24) hours if reasonably necessary to verify the winner and arrange delivery before the Fair.
Destination Markham Corporation is not required to continue selecting alternate entrants if there is insufficient time to verify an alternate winner and arrange Prize delivery before the Fair.
PRIZE CLAIM
Before being declared a winner and receiving a Prize, each selected entrant must:
1. Correctly answer, without assistance of any kind, a mathematical skill-testing question administered by Destination Markham Corporation;
2. Confirm that they meet all eligibility requirements and have complied with these Contest Rules;
3. Complete, sign and return the Destination Markham 2026 Markham Fair Family Pass Giveaway Prize Claim Form within the time specified by Destination Markham Corporation;
4. Release Destination Markham Corporation and the Released Parties identified below from liability relating to the Contest, the Prize and attendance at the Markham Fair;
5. Consent to the limited use of their name, city and province or territory of residence, Instagram username, photograph and/or likeness for Contest-related publicity carried out by Destination Markham Corporation, without additional compensation, except where prohibited by law; and
6. Provide a valid email address and any other information reasonably required to arrange electronic delivery of the Prize.
Failure to satisfy any of these requirements will result in disqualification and forfeiture of the Prize.
PERSONAL INFORMATION
By entering the Contest, entrants consent to their personal information being collected, stored, used and processed by Destination Markham Corporation for the purposes of administering the Contest, recording and validating entries, confirming eligibility, contacting and verifying selected entrants, preventing fraud or misuse, arranging Prize fulfilment and satisfying applicable legal, regulatory and recordkeeping requirements.
Destination Markham Corporation may disclose the minimum personal information reasonably required to Markham Fair and its ticketing provider solely for the purpose of delivering a Prize to a confirmed winner.
Personal information collected for Contest administration will not be used to send commercial electronic messages unless the entrant has separately provided valid consent to receive such communications.
Where an entrant voluntarily provides express consent to receive Destination Markham Corporation’s electronic newsletter or other commercial electronic messages, Destination Markham Corporation may use the entrant’s contact information for those purposes. Entrants may withdraw that consent at any time using the unsubscribe mechanism provided in such communications.
Information posted publicly on Instagram, including an entrant’s username, comment and tagged accounts, may be visible to other Instagram users and is also subject to Instagram’s applicable privacy policies and terms.
INSTAGRAM AND FACEBOOK DISCLAIMER
This Contest is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook or Meta Platforms, Inc.
By entering the Contest, each entrant releases Instagram, Facebook and Meta Platforms, Inc. from claims arising from or relating to the administration of the Contest.
Any questions, comments or complaints regarding the Contest must be directed to Destination Markham Corporation and not to Instagram, Facebook or Meta Platforms, Inc.
MARKHAM FAIR AND CITY OF MARKHAM DISCLAIMER
The Markham and East York Agricultural Society, operating as Markham Fair, is providing the Prizes and arranging electronic Prize fulfilment but is not responsible for administering the Contest, collecting or validating Contest entries, determining entrant eligibility, conducting the random draw, selecting potential winners or notifying potential winners.
The City of Markham is not a sponsor or administrator of the Contest and is not responsible for administering the Contest, collecting or validating entries, selecting or contacting potential winners, or awarding the Prizes.
For the purposes of these Contest Rules, the City of Markham, Markham Fair, Instagram, Facebook, Meta Platforms, Inc., the applicable ticketing provider, and each of their respective elected officials where applicable, directors, officers, employees, representatives, agents and affiliates are collectively referred to as the “Released Parties.”
RELEASE AND LIMITATION OF LIABILITY
By entering the Contest, each entrant agrees to release, indemnify and hold harmless Destination Markham Corporation and the Released Parties, and each of their respective elected officials where applicable, directors, officers, employees, representatives, agents, affiliates, successors and assigns, from claims, losses, damages, expenses, actions or liabilities arising directly or indirectly from participation in the Contest, the administration of the Contest, being selected or not selected as a winner, incorrect or incomplete entry information, technical failures, lost or inaccessible entries or communications, acceptance or use of a Prize, travel to or attendance at the Markham Fair, the acts or omissions of a winner or their guests, postponement or cancellation of the Fair, changes to Fair programming, personal injury, property damage, loss or expense connected with use of the Prize, or technical, ticketing, venue, security or operational matters associated with the Prize.
Nothing in these Contest Rules is intended to exclude liability that cannot lawfully be excluded under applicable law.
TECHNICAL PROBLEMS
Destination Markham Corporation and the Released Parties are not responsible for interrupted or unavailable internet, mobile, telephone or platform services; failed, incomplete, delayed or misdirected communications; Instagram outages or technical problems; account privacy settings that prevent an entry from being viewed or verified; deleted, hidden or filtered comments; suspended, disabled or inaccessible accounts; failed electronic Prize delivery; failure by an entrant to monitor direct messages, email or spam folders; or any other technical problem outside their reasonable control.
Proof that an entrant attempted to submit an entry does not constitute proof that the entry was received, recorded or accepted.
GENERAL
By entering the Contest, entrants agree to comply with these Contest Rules. All decisions of Destination Markham Corporation concerning the Contest are final and binding, subject to applicable law.
Destination Markham Corporation reserves the right, in its sole discretion, to prohibit any person from entering the Contest or to disqualify any entrant whom it believes has provided false or misleading information, used automated entry methods, attempted to circumvent the entry requirements, tampered with the entry process, interfered with the proper administration of the Contest, engaged in fraudulent or abusive conduct, violated these Contest Rules or violated Instagram’s applicable terms, policies or community standards.
Destination Markham Corporation reserves the right to cancel, modify, suspend or terminate the Contest or these Contest Rules, in whole or in part, if fraud, technical failures, platform changes, unauthorized intervention or any other cause beyond its reasonable control affects the proper administration, security, fairness or integrity of the Contest.
If the Contest is cancelled or terminated after eligible entries have been received, Destination Markham Corporation may select potential winners from among the eligible entries received before the cancellation or termination, where reasonably possible.
Destination Markham Corporation’s failure to enforce any provision of these Contest Rules will not constitute a waiver of that provision.
If any provision of these Contest Rules is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
The Contest is subject to all applicable federal, provincial, territorial and municipal laws and regulations and is void where prohibited.
